they the Magistrates could not release him
he then proposed that they the Magistrates
should apply to parliamt to wch it was
immediately answered that the County
did not seek Relief because their Remedy
was upon the sd Arcles & Bond and that
if he wanted to be relieved he himself
must apply for that purpose and that
the County had no Idea of releasing him
but by sd Command and under sd Sanction
of parliamt and if then upon paymt
of the full Sum – Mr Errington or
Mr Heron his Attorney & in his presence
agreed to draw out the Heads of what
he Mr Errington wished to be relieved from
and the Conditions of that Relief and
lay before the Magistrates those Heads
for their Consideration on Behalf of
the County at the then next & now last
Michas Sesons, and if such Heads were
thought just & proper for them as Justices
for the public to consent to that Mr
Kenyon for the County and Mr Wallace
for Mr Errington might settle a Bill
grounded on such Heads But no such
Heads were ever drawn or presented
at Michas Sesons or at any Time since
nor has any Communication been had
by Mr Errington with the County since
sd Midsr Sesons nor did they know the
nature or purport of the petn till after
it had been presented to parliant
The Justices at Midsr Sesons testified | That the Justices appeared to be
how sorry they were that such an | sensible of the Truth etc
Accident should have happened and
informed Mr Errington that however
inclined they might be to relieve him
they could not do so, at the same Time
they did not appear to be sensible of
the Inexpediency of building a Bridge
because it was suggested by some of
the Magistrates then present that Mr
Errington might build another Bridge
at a little more Expence by securing the
Foundation in a different manner or as
the Bridge at Corbridge and the other
Bridges on Tyne were which Bridge
at Corbridge was & is an apparent
standing Contradiction to Mr Smeatons
Opinion however able he may be in his
